1. About Bon Temps NOLA

Bon Temps NOLA Personal Concierge ("Bon Temps," "we," "our," or "us") is a personal concierge service that coordinates errands, deliveries, grocery pickups, restaurant orders, transportation, pharmacy runs, and other personal tasks on behalf of clients in the Greater New Orleans area and surrounding regions. Our platform is accessible at www.bontempsnola.com.

2. Eligibility

• You must be at least 18 years of age to create an account or place a request.
• By using our service, you represent that you have the legal authority to enter into this agreement.
• Accounts may not be created on behalf of another person without their knowledge and consent.

3. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to keep your information up to date.
• Bon Temps reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Profile Recipients and Invited Users

Account Holders may add other individuals ("Profile Recipients") to their account to coordinate services on their behalf.

• By adding a Profile Recipient, you confirm you have their permission to share their personal information with Bon Temps.
• Profile Recipients will receive an invitation via SMS or email and must accept these Terms and Conditions before their profile becomes active.
• Profile Recipients may edit their own address and preferences through their account login. All changes are permanently logged.
• Account Holders are responsible for ensuring that any Profile Recipient they add has consented to receiving communications from Bon Temps.

5. SMS Communications and Consent

• You consent to receive transactional SMS messages including order confirmations, delivery status updates, helper assignments, and account notifications.
• Message frequency depends on your service activity.
• To opt out, reply STOP to any message. To resume, reply START.
• SMS consent is not a condition of purchasing services.

6. Services and Requests

• Bon Temps acts as a coordinator and facilitator. We connect you with independent helpers and drivers ("Service Providers") who fulfill your requests.
• All service estimates shown on our platform are estimates only. Final charges may vary based on actual time, distance, and complexity.
• Bon Temps reserves the right to decline any request that is unlawful, unsafe, or outside our service area.
• Requests involving prescription medications require accurate pharmacy and prescription information. We are not responsible for errors resulting from inaccurate information provided by the client.
• Same-day and after-hours requests may incur additional convenience fees, which will be displayed before confirmation.

7. Pricing and Payment

• All prices shown are estimates. Final charges are confirmed upon coordinator approval before dispatch.
• Payment is processed securely through our payment provider. By submitting a request, you authorize the estimated charge.
• Service fees, convenience fees, and applicable taxes are added to each order and displayed in your service summary.
• Refunds are handled on a case-by-case basis. Contact us at legal@bontempsnola.com within 48 hours of service completion to report an issue.

8. Cancellations and Changes

• You may cancel or modify a request before a helper has been assigned at no charge.
• Cancellations after helper assignment may incur a cancellation fee.
• Changes to an active order must be requested through the platform and are subject to coordinator approval.

9. Audit Logs and Record Keeping

For your protection and ours, Bon Temps permanently logs all account activity including:

• Profile creation, edits, and deletions — including who made each change and when
• Order placements, modifications, confirmations, and cancellations
• Invite sends and acceptance events
• Login and authentication events

These records are maintained for a minimum of 7 years and may be used in dispute resolution, legal proceedings, or safety investigations. Deletion of your account does not erase audit records.

10. Prohibited Uses

You agree not to use Bon Temps NOLA to:

• Transport, purchase, or deliver illegal substances or items
• Harass, threaten, or harm any Bon Temps employee, helper, or driver
• Provide false information about your identity, location, or the nature of a request
• Use the platform for any commercial purpose without prior written consent
• Attempt to reverse-engineer, hack, or interfere with our platform
• Violate any applicable local, state, or federal law

11. Health, Allergy, and Safety Information

• Update allergy and medical information promptly whenever it changes.
• All updates are timestamped and logged. "I told you" is documented — our logs show exactly what was on file and when.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• Bon Temps is a coordinator, not a direct service provider. We are not liable for the actions, errors, or negligence of independent Service Providers.
• Our total liability to you for any claim arising from use of our service is limited to the amount you paid for the specific order in question.
• We are not liable for indirect, incidental, special, or consequential damages including lost profits, loss of data, or personal injury beyond what applicable law requires.

13. Indemnification

You agree to indemnify and hold Bon Temps NOLA, its officers, employees, helpers, and partners harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of our service, your violation of these Terms, or your violation of any third-party rights.

14. Intellectual Property

All content on the Bon Temps NOLA platform — including the name, logo, design, software, and written content — is owned by or licensed to Bon Temps NOLA. You may not reproduce, distribute, or create derivative works without our written permission.

15. Privacy

Your use of Bon Temps NOLA is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or SMS. Your continued use of the service after notice constitutes acceptance of the updated Terms. The current version is always available at www.bontempsnola.com/terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our service shall be resolved in the courts of Orleans Parish, Louisiana, unless otherwise required by applicable law.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bon Temps NOLA regarding your use of our service and supersede all prior agreements.
